By accessing or using the NOCTURNE website, app, or services ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
NOCTURNE provides estimated real-time venue occupancy information for bars and nightlife venues. Occupancy data is derived from WiFi signal counting and other data sources. All counts are estimates and should not be relied upon for safety, legal, or regulatory compliance purposes.
NOCTURNE provides estimated crowd counts, not exact headcounts. Actual occupancy may differ from displayed numbers. We do not guarantee the accuracy, completeness, or timeliness of any data displayed. Venue owners are responsible for their own compliance with fire marshal capacity limits and all applicable regulations. NOCTURNE is a supplementary tool, not a replacement for manual safety processes.
You agree to use the Service only for lawful purposes. You may not use NOCTURNE data to stalk, harass, or monitor any individual. You may not attempt to reverse-engineer the Service, extract data through automated means, or interfere with the operation of the Service.
Venue owners participating in the NOCTURNE pilot program agree to allow the installation of a WiFi counting sensor at their venue, provide power and WiFi connectivity for the sensor, and allow NOCTURNE to display aggregated (non-identifying) area activity data derived in part from their venue's occupancy. Individual venue data is private and will not be shared with competing venues. Venue owners may request removal of the sensor at any time by contacting us.
All content, design, code, and data on NOCTURNE is owned by NOCTURNE and its founder. You may not copy, reproduce, or redistribute any part of the Service without written permission.
NOCTURNE is provided "as is" without warranties of any kind, express or implied. In no event shall NOCTURNE, its founder, or its affiliates be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the Service (which, during the pilot, is $0).
You agree to indemnify and hold harmless NOCTURNE and its founder from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
We may suspend or terminate your access to the Service at any time, for any reason, without notice. Venue owners may terminate their participation at any time by requesting sensor removal.
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Orange County, California.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
